To facilitate creditors from the European Union, the European Parliament and the Council have adopted a series of Regulations aiming at a fast and efficient procedure for the debt collection in the Union. One of these is Regulation 1215/2012 of the European Parliament and of the Council on jurisdiction, recognition, and enforcement of judgments in civil and commercial matters, replacing its predecessor Regulation (EC) No 44/2001.
In accordance with Regulation 1215/2012 of the European Parliament and of the Council, a judicial decision rendered in another Member State of the European Union is subject to enforcement without the need for issuing an enforcement order. Enforcement proceedings are directly initiated before the competent local enforcement authority based on:
- Translation of the apostilled judicial decision from the foreign court.
- Certificate under Article 53 of Regulation 1215/2012 of the European Parliament and of the Council on jurisdiction, recognition, and enforcement of judgments in civil and commercial matters. The certificates under Article 53 follow a commonly accepted template, represented by Annex I to the regulation.CERTIFICATE 53 EN
- Application to the judicial enforcement authority to initiate enforcement proceedings.
